LEGAL AND PRIVACY INFORMATION

SCOTTISH WIDOWS APP TERMS

1. Scope of services provided by the Scottish Widows App

Scheme members and individual pension holders can access information in a variety of ways.

These terms and conditions define the ways in which you, as a registered user, may access and use the Scottish Widows App ("SW App").

SW App means the software application itself and the information, content and services we make available; or that pension scheme trustees ask us to make available to individuals with Scottish Widows pension products. This may include such services and products as fund valuations, payment history, and others as we make them available ("the services").

Services can only be used in accordance with your pension scheme rules and policy provisions. Copies are available on request. For matters specifically governing your use of the SW App, the terms and conditions of the SW App will prevail.

If you have a retirement saver, workplace pension or personal pension, please read the appropriate privacy policy for your pension plan available at: www.scottishwidows.co.uk/legalprivacy

This explains how we use your personal information and our use of cookies.

For retirement accounts, your privacy policy can be found on your pension information website. Instructions on accessing this website were provided when you joined and are included in your annual benefit statement.

The SW App can be used on most iOS and Android devices. We may prevent access to our services if you use a device or operating system that cannot support the latest version of the SW App.

The SW App is designed for use in the UK. We don't charge for this but your mobile operator may. Services may be affected by phone signal and/or functionality.

2. Your use of the services

Your right to use the services is personal. You may not permit any other person to access the services using your username or password.

You must download the SW App to your phone and register before you can use it. As part of the registration process, we will collect your email address - this is used as your SW App username. You will be asked to create a password. Both may be required when you log in.

We may also rely on some of the in-built security functions, such as biometrics, when you access the SW App. As a minimum, you must enable and maintain your device's PIN code.

You must ensure that only your biometric information (such as fingerprint for Touch ID) is registered on any device used to access the SW App. Scottish Widows does not accept responsibility for any unauthorised use of your username, password or other security details resulting from your negligence in keeping your security information safe at all times.

If you become aware of, or suspect, any unauthorised use of the services or any breach of security in your username, password or details you must notify Scottish Widows immediately.

Once you log in to the SW App, you will remain logged in for a period of up to 6 months. After which you will be required to log back in. Unless you choose the automatic log out function (within settings), then you will be required to log in with each return visit. This applies whether you rely on username and password or biometric access.

We reserve the right to deactivate your security details if you fail to comply with these terms and conditions or those of any product or service made available to you through SW App; or where we are required to do so by any applicable law, regulation or government body. In these instances, you will need to re-register to enable the SW App.

3. Disclaimer and limitations of liability

The SW App and its services may be briefly unavailable between 3am and 6am each day. This allows for data refreshes and general maintenance.

Your access may be prevented by factors outside of Scottish Widows' control, e.g. issues with Internet access, telephonic and other electronic services; or problems with the device you are using.

We will not be liable for any loss you incur in such circumstances. This is also because you can obtain information or give instructions to us by other means, such as calling us during working hours.

Scottish Widows has taken all reasonable care in the preparation of the services. However, if you are in any doubt, as to the accuracy of information provided on the services, we first recommend contacting us directly via our help desk or that you obtain independent professional advice. Scottish Widows cannot accept any liability for inaccurate information on the services where not due to our negligence.

4. Acceptance of instructions by Scottish Widows

Your use of the services is your authorisation to Scottish Widows to treat any instructions, sent via the services, as valid instructions, without the need for further written advice. Please note, Scottish Widows can only process your instruction where it is in accordance with the policy provisions and pension scheme rules that apply to your policy.

Scottish Widows may need to verify the instruction you send via the services before carrying out the instruction.

Scottish Widows will only be liable for any failure to carry out any instruction received through the services or for undelivered instructions if the failure or non-delivery was due to negligence on Scottish Widows’ part.

5. General

Scottish Widows may restrict, suspend or terminate your use of the services where this is reasonably necessary.

Scottish Widows may vary these terms at any time to:

  • reflect a change in applicable law, regulation or industry practice,
  • improve the efficiency of the services.

Amended terms are accessible within the Help tab of the SW App. Your continued use of the services will be deemed to be your consent to the revised terms. You are free to discontinue your use of the services with us at any time and may stop your use of the SW App at any time by removing it from your device.

Scottish Widows owns the trademarks, copyright and any other intellectual property rights to the SW App and the information and data relating to the provision of the services.

English law shall apply to these terms.

Separate terms apply to the use of third-party websites and Scottish Widows does not warrant the accuracy, reliability, availability or otherwise of these sites.
